Foundations of the Unified Iraqi Retirement Law and Social Security Retirement
The Department of Legal Studies at Bayt Al-Hikma (House of Wisdom) held its scientific seminar titled "Foundations of the Unified Iraqi Retirement Law and Social Security Retirement," on Thursday, November 20, 2025, at Dr. Mahmoud Ali Al-Dawood Hall at Bayt Al-Hikma.
The seminar shed light on one of the files most closely related to the lives and economic stability of citizens, including civilian and military employees, and those incapable of work, given the need to develop the retirement system to keep pace with economic changes. It also aimed to evaluate legal legislation and explore the possibilities of reforming social protection systems and strengthening their guarantees for workers in both public and private sectors.
The session was chaired by Advisor Dr. Izz al-Din Al-Muhammadi, Supervisor of the Department of Legal Studies at Bayt Al-Hikma, and was rapportuerd by Dr. Thikra Ina'm Ghayib , rapportuer of the department.
The seminar included the presentation of several different research papers .The first axis was "The Constitutional and Legal Framework for the Retirement of State Employees and Workers' Social Security," which presented by Asst. Prof.Dr. Shamil Hadi Al-Azzawi from Mustansiriyah University. He clarified the legal and constitutional foundations that regulate retirement rights for employees and workers, including national legislation that defines retirement entitlements and their conditions. He also discussed the intellectual background from which the Unified Retirement Law emerged and its consistency with the principles of protecting workers' rights under Law No. (18) of 2023.
The second Axis "Foundations of the Unified Retirement Law and the State Employees' Retirement Fund was presented by Dr. Haidar Al-Khafaji, Director General of the State Employees' Retirement Fund. He discussed the difference between companies and governmental institutions in retirement systems under the Unified Retirement Law, including: the legal and organizational foundations, sources of funding, calculation of the pension salary, guarantees of continuity, and the nature of the system. He also talked about the establishment of the Retirement Fund and its laws, and the difference between it and the General Retirement Authority.
The third Axis " Administrative and Financial Foundations of Workers' Social Security Retirement " which was presented by
Legal Consultant Mr. Waleed Mahmoud talked about "The Administrative and Financial Foundations of Workers' Social Security Retirement." He pointed to the concept of social security as a complement to the retirement system, clarified those who are covered by social security, and the mechanism for calculating contributions and retirement service for workers in this sector. He also highlighted the essential differences between the retirement of state employees and workers' retirement.
Finally, the forth axis titled "Applied Challenges, Problems, and Future Reform Trends" , presented by Assistant Legal Consultant Mr. Raghed Hisham Abboud. He explained the most prominent problems facing retirement legislation and systems, such as administrative complexity, the need to update instructions, and the development of follow-up mechanisms. He also stressed the importance of updating legislation to enhance governance and oversight, and developing digital systems to raise procedural efficiency and better guarantee the rights of retirees.
The seminar was attended by a group of academics, researchers, and professors specialized in legal affairs and administrative reform issues, who enriched the discussion with their comments .
